Dynegy ERISA Litigation
The In re Dynegy, Inc. ERISA Litigation Complaint was filed in the United States District Court for the Southern District of Texas, Houston Division, on behalf of Plaintiffs and a class (the "Class") of all persons who were participants in or beneficiaries of Dynegy, Inc. 401(k) Savings Plan (formerly known as the Dynegy Inc. Profit Sharing 401(k) Savings Plan and the NGC Profit Sharing/401(k) Savings Plan) (the “Plan”) between April 27, 1999 and January 30, 2003 (the "Class Period").
Settlement - Final Approval of $30.75 Million Settlement
On December 10, 2004, the Court entered its Order and Final Judgment; Final Order Approving an Award of Attorneys’ Fees, Reimbursement of Expenses and Incentive Award to the Named Plaintiff; and Order Approving Plan of Allocation. In settlement of this case, the Defendants have agreed to reimburse the class members for their alleged losses in the amount of $30.75 million. The Court approved the settlement so this money will be used to compensate the class members, the class representative, and attorneys for the class. It will also be used to pay the cost of the settlement administration.
